GHAI is part of the Bloomberg Philanthropies Data for Health (D4H) Initiative, which supports low- and middle-income countries in Africa, Latin America, and Asia and the Pacific to improve civil registration and vital statistics (CRVS) systems. Civil registration systems are the systems that register births, deaths, fetal deaths, and other vital events. Civil registration data is used to produce vital statistics, which are essential for government planning and policymaking; and birth and death registration create and retire an individual's legal identity.

Under the D4H Initiative, GHAI provides technical assistance to help countries strengthen their CRVSID systems through (1) legal reviews and reforms and (2) budget advocacy for increased and sustainable funding of these systems. D4H partner organizations are currently running projects in Morocco and the government has requested assistance with undertaking a legal review of the CRVSID system with a view to amending the legal framework in line with best practice.



About the position:
GHAI seeks an in-country legal consultant to support a review and reform of the CRVS legal framework in Morocco. This involves an analysis of the CRVS laws and system to identify gaps, bottlenecks and obstacles to a well-functioning and integrated CRVSID system and recommend how the relevant legal instruments (laws, regulations, guidelines, SOPs, etc.) can be reformed, amended or created anew to better align with international best practices. The consultant will then work with and assist government officials in taking the legal reform process forward, according to the priorities of the government, including providing technical assistance in drafting relevant legal instruments where required.
The consultant will work in close coordination with government officials and D4H partner organizations as part of a broader program to improve CRVS systems in Morocco.
Training on the CRVS best practice and legal review process will be provided to the consultant.

Duration and basis of consultancy



The consultancy will initially be a full-time position for 12 months from approximately 1 September 2023 to 31 August 2024.
Additional work may be agreed upon after the initial consultancy period, depending on the stage at which the legal review and reform project has reached and upon agreement with the Moroccan government and D4H partner organization as to the further work required.
This position is based in Morocco. + Attend CRVS Best Practices Training (offered by GHAI);
+ Gather all relevant CRVS legal documents (laws, regulations, decrees, guidelines, standard operating procedures, circulars, manuals, etc.);
+ Attend and participate in the CRVS Legal Review Launch Workshop and assist with preparations and presentations as necessary;
+ Request missing information through informational interviews with key CRVS stakeholders;
+ Undertake a comprehensive and complete analysis of Morocco's legal framework applying global best practice and using those chapters of the Data for Health CRVS Legal and Regulatory Review Toolkit that have been selected by the relevant government agencies;
+ Draft a Recommendations Report based on the findings from the Toolkit analysis, and make the revisions and edits requested by GHAI and the stakeholders until the report is finalized;
+ Present the Recommendation Report at a second workshop;
+ Revise the Recommendation Report based on Stakeholder and GHAI feedback;
+ Regularly communicate with and update the relevant national stakeholders involved in CRVS to ensure they remain involved with, and informed about, the project's outputs;
+ Apply a strong working knowledge of the Morocco political and administrative systems, processes and players to identify opportunities to advocate for changes and prioritization of CRVS legal reforms;
+ Build and maintain relations with key governmental officials and political leaders to achieve CRVS legal reform;
+ Provide technical assistance with drafting laws, regulations, SOPs and guidelines, as required, to ensure the legal reforms are comprehensive and in line with best practices;
+ Prepare detailed monthly, quarterly and other reports on progress as requested.
+ Communicate progress with GHAI staff as required and coordinate closely with the Bloomberg D4H Health Initiative partner organizations.

SKILLS YOU'LL BRING TO THE ROLE:



+ A law degree from a law school accredited by the national authority. Advanced degree in public health, public policy, health financing or other relevant field highly desirable.
+ Five to ten years of relevant legal experience (practicing or teaching) preferably including in relation to public health or broader public sector issues.
+ A strong understanding of Morocco's legal system, including how laws, regulations and other legal documents are developed, drafted, and adopted.
+ Strong understanding of the constitutional structure, administrative systems, and policy-making procedures in Morocco.
+ Knowledge of and experience in using legal analysis to advance policy change objectives.
+ A background in human rights, civil rights, public affairs, or regulatory affairs preferred.
+ Excellent analytical skills, legal writing and research ability.
+ Experience in legal analysis of public health or public policy issues.
+ Ability to communicate and work closely with government stakeholders, local and global partners.
+ Ability to take initiative and work independently with general supervision and oversight.
+ Ability to travel domestically and internationally.
+ Some knowledge of civil registration, vital statistics and/or identity management (CRVS) is desirable, however, experience in CRVS is not required; training will be provided
+ English language proficiency is highly desirable but not essential.
